City of Redlands Redlands Recreation Services Division  COMMUNITY GARDEN ACTIVITY FORM AND WAIVER OF LIABILITY  PLEASE READ BELOW It is understood that I (the participant) cannot participate in the activities until this waiver form has been completed. WAIVER, RELEASE AND INDEMNITY AGREEMENT For and in consideration of permitting the undersigned individual to participate in the City of Redlands Community Garden Program, (“Program”) the undersigned hereby voluntarily forever releases, discharges, waives, and relinquishes any and all actions or causes of action for personal injury, property damage or wrongful death occurring to the undersigned which may arise out the undersigned’s participation in the Program and activities incidental thereto, for him/herself and his/her heirs, executor’s, administrators, and assigns. The undersigned further agrees that he/she shall not prosecute or presents any claim for personal injury, property damage, or wrongful death against the City of Redlands or any of its elected officials, agents or employees (herein referred to as “Releasees”) for any of such causes of action.  The undersigned acknowledges, understands and assumes the risks inherent in recreation activities, that such activities entail risks of physical injury to his/her person and property, and that the undersigned is participating in the Program with full knowledge of these risks. The undersigned further acknowledges and understands that this waiver includes, but is not limited to, any action or cause of action arising from (1) the City’s performance of, or failure to perform, maintenance, inspection, supervision, control or security of the property on which the Program will occur; (2) for the City’s failure to warn of dangerous conditions existing on or near the property on which the Program will occur; (3) for any acts or omissions by spectators; (4) for the City’s supervision or selection of officials, players, coaches; or (5) for any hidden latent or obvious defects or dangerous conditions existing on or near the property on which the Program will occur.  IT IS THE INTENTION OF THE UNDERSIGNED BY EXECUTING THIS INSTRUMENT TO EXEMPT AND RELIEVE RELEASEES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE AND WRONGFUL DEATH CAUSED BY THE PASSIVE NEGLIGENCE OF THE RELEASEES  The undersigned for him/herself, and his/her heirs, executors, administrators or assigns, agrees that in the event any claim for the undersigned’s personal injury, property damage or wrongful death shall be prosecuted against Releasees he/she shall indemnify and save harmless Releasees from any and all claims or causes of action by whomever or wherever made or presented for the undersigned’s personal injury, property damage or wrongful death.  The undersigned acknowledges that he/she has fully read this Waiver, Release and Indemnity Agreement and has been fully and completely advised concerning the effects of this Waiver, Release, and Indemnity Agreement and is fully aware of the legal consequences of signing this document.  I have read and hereby agree to abide by the Community Garden Rules and Procedures. I further acknowledge by participating in the City of Redlands’ Community Garden Program will be jeopardized should I fail to adhere to the rules.    PLEASE RETURN THIS FORM WITH YOUR PAYMENT

CIUDAD DE REDLANDS COMUNIDAD HUERTO PROGRAMA  CONDICIONES DE USO  1. Los participantes podrán jardín a su propia conveniencia durante las horas de luz. El jardín está abierto el amanecer hasta el anochecer, siete días a la semana. La jardinería no se llevarán a cabo durante las horas nocturnas.  2. La ciudad proporcionará agua para los huertos. Jardineros deberán estar presentes en sus parcelas mientras están regando. No leaver agua desatendidos o sin supervisión. No inundación pathways u otros jardines. Los temporizadores son permitidos, aunque deben mantenerse en buen estado de funcionamiento.  3. Animales domésticos de cualquier tipo no están permitidos en el área de jardín.  4. Los jardines comunitarios están destinados únicamente para uso personal. Jardinería para fines comerciales no está permitido. Todas las semillas, abonos, fertilizantes y equipo son responsabilidad del participante del jardín.  5. Parcela del jardín se espera que los participantes mantengan sus parcelas clara y libre de malezas, hierbas, y otros restos que pueden albergar insectos. Las malezas más de uno (1) pies de alto, o las malas hierbas con cabezas de semillas debe ser eliminado. Definiciones de malezas incluyen "diablo" (hierba Bermuda), tuerca (hierba), la cual puede propagarse y estrangule otras plantas.  6. Cultivos, plantas, lianas y vegetación deben estar contenidas dentro de los límites de la parcela del jardín para que no se solape en vías adyacentes o huertos.  7. Los huertos serán inspeccionados sobre una base mensual. Los participantes que desatienden sus parcelas serán notificados por escrito de su fracaso a la hora de realizar tareas de jardinería obligatorias. Los participantes que no cumplan con las normas y procedimientos del huerto después de recibir notificación escrita tendrá su arrendamiento terminado con ningún reembolso de tasas.  8. Se alienta a los participantes a utilizar todos los métodos de conservación de agua. Por favor reporte cualquier grifos con fugas o problemas con el agua a la Comunidad Senior Center. Sobrecarga el riego no está permitido. Los participantes no deben agua cualquier parcela distinto del propio.  9. Topos u otros roedores deben ser atrapado pero no envenenado.  10. Si usted es la última persona en el jardín, por favor, cierre bien la puerta.  11. Los huertos no pueden ser utilizadas para el cultivo de plantas ilegales de ningún tipo.  12. Árboles de cualquier tipo no están permitidos en los huertos. Los árboles "voluntarios", es decir, los árboles que salen en sus propios debe retirarse inmediatamente.  13. Los huertos pueden ser utilizadas para el cultivo de hortalizas, hierbas y flores.
